Food Requirement - More Information
Executive Order 202.43 (EO) / June 18, 2020The purpose of this policy is to ensure that patrons are enjoying a sit-down dining experience, and not a drinking or bar-type experience which often tends to be problematic from a public health perspective.
For each person in a seated party, an item of food must be purchased at the same time as the purchase of the initial alcoholic beverage
One or more sharable food item(s) may be purchased, so long as the food item would
sufficiently serve the number of people in the party
Food item must be sandwiches, soups or other foods, including but not limited to cheese, fruits
vegetables, chocolates, breads, mustards & crackers, salads, wings, or hotdogs
however, a bag of chips, bowl of nuts, or candy alone are not sufficient examples Q: Must a patron order food with each alcoholic beverage ordered?
A: No, as long as food is ordered at the time of initial order of any alcoholic beverages
that is sufficient in substance and is also of a quantity sufficient to serve the number of
patrons who are present and being served alcohol.
Businesses selling or serving alcohol to be consumed at the business or elsewhere
must ensure that everyone within 100 feet of their business is:
In compliance with open-container, social-distancing, and face-covering rules; and
Following all existing rules, regulations, and laws.
Violations could result in having a license suspended or revoked, with fines up to $10,000 per violation.
Patrons can also be fined for breaking open container or social distancing rules. Governor Cuomo announced that the multi-agency task force to combat violations of coronavirus-related
regulations at bars and restaurants conducted nearly 1,100 compliance checks between July 21 and July 23,
documenting violations at 84 establishments.
Businesses found in violation of COVID-19 regulations face fines up to $10,000 per violation,
while egregious violations can result in the immediate suspension of a bar or restaurant's liquor license.
